The European Union has a framework decision on “combating certain forms and expressions of racism and xenophobia by means of criminal law” . 

This decision requires the criminalization of public incitement to violence or hatred based on race, color, religion, descent, or national or ethnic origin . The United Nations High Commissioner for Refugees (UNHCR) has also recommended that states declare an offense punishable by law all dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination, as well as all acts of violence or incitement to such acts against any race or group of persons of another color or ethnic origin, and also the provision of any assistance to racist activities, including the financing thereof. 

The legal framework for addressing “hate speech” in Europe is complex, and there is no international definition of “hate speech”. However, there are several soft law instruments that provide guidance on the definition of “hate speech”.
